The purpose of our services via WhatsApp is to provide users with an easy and convenient experience by connecting them with local merchants to fulfill their orders. Users can order a variety of products, including ready-made food, beverages, non-ready food items, and non-food items (referred to as “products”).

Our interactive platform allows users to place and send orders via WhatsApp with a single click. When you place an order from a merchant, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C acts as an intermediary on behalf of the merchant to complete your order and manage your experience. Each merchant has a dedicated WhatsApp number that uses MARKCOGNITION technology to facilitate the process and provide service.

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C does not sell or produce any products or services; rather, it provides users with a means to directly communicate with merchants via their dedicated WhatsApp numbers, supported by MARKCOGNITION technology to facilitate orders and provide service. Merchants are responsible for complying with local laws, regulations, and standards related to the preparation, sale, and marketing of products and services.

### Users’ Acknowledgment

Users should be aware that MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C does not independently verify the credentials or claims of merchants, the quality of the products offered, or the compliance of merchants with applicable laws. Users are responsible for ensuring the quality and reliability of the products and services provided by merchants, as well as their compliance with the prevailing laws.

We reserve the right, without obligation, to restrict or limit the sales of products to any person, geographic region, or jurisdiction. Due to applicable laws in some countries, we may not display certain products or restricted products for sale; any offer of products made via WhatsApp is considered null and void if prohibited by law.

### Product Quality and Legal Compliance

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C disclaims any responsibility for ensuring the quality of any products or their compliance with applicable laws, and does not guarantee that the product listings displayed via WhatsApp match what is actually provided to users. Additionally, a merchant may claim that the preparation of products and services meets specific standards, such as (but not limited to) “organic” or “vegan” standards or standards related to allergens, such as (but not limited to) “nut-free, gluten-free, or lactose-free foods.” However, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C is not responsible for providing information regarding ingredients or allergens via WhatsApp.

Furthermore, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C does not guarantee that products sold by merchants are free from allergens, unless otherwise required by applicable laws. If you suffer from allergies, allergic reactions, or have dietary restrictions and requirements, it is advisable to contact the merchant directly before ordering any products via WhatsApp to verify the ingredients and ensure their safety.

### Order Fulfillment

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C and the merchants associated with it strive to reasonably adhere to your specific instructions for your order. However, in cases where it is not possible, unavailable, or commercially impractical, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C and/or the merchants reserve the right to fulfill the order according to standard operating procedures. Neither MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C nor the merchants are liable for replacing or refunding an order that does not comply with the specific instructions you provided.

Additionally, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C is not legally responsible for any goods or services provided by merchants that are unhealthy, cause harm, are unacceptable to users, or fail to meet their expectations in any way.

### Responsibility for Addresses and Delivery

It is solely the responsibility of users to verify the accuracy of delivery addresses. MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C holds no legal responsibility or liability for any incorrect addresses provided. The merchant who accepts the order is solely responsible for the preparation and delivery of all goods and services.

Please be aware that the merchant will make every effort to adhere to the specified delivery time. However, delivery times may be affected by factors beyond their control, and therefore, delivery time adherence cannot be guaranteed. We will notify you if we become aware of any unexpected delays.

### Using WhatsApp Number for Communication

At MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C, we utilize a unique system for communication and order fulfillment. Instead of creating an account on the platform, a dedicated WhatsApp number is provided for each merchant, and communication is conducted through this number to complete orders and handle inquiries. Using our services via WhatsApp does not require creating an account or setting up a username and password.

### WhatsApp Ordering Steps

1. **Contacting the Merchant**: A dedicated WhatsApp number is assigned to each merchant, supported by MARKCOGNITION technology. Users can use this number to place orders and make inquiries.

2. **Order Completion**: After contacting the merchant via WhatsApp, users can directly send their orders through the chat. The merchant will respond to the order and confirm the required details.

3. **Order Management**: The merchant manages the order using the technology provided by MARKCOGNITION to ensure service accuracy and speed.

### Data Protection and Privacy

Our services do not require the entry of any sensitive personal information, such as passwords. However, we are committed to protecting users’ data and any information exchanged via WhatsApp. The merchant is solely responsible for the data related to orders, and we are committed to providing the technology that supports data protection and privacy.

### Permitted Activities

Users must use the merchant’s designated WhatsApp number for lawful and legitimate purposes only. The following are not permitted:

1. **Distribution of Illegal Materials**: Including defamatory, offensive, or otherwise illegal materials.
2. **Interference with Others’ Use of the Service**: Such as attempts at hacking or interfering with the operation of the merchant’s system.
3. **Using the Service in Unlawful Ways**: Such as attempting unauthorized access or causing harm to the merchant’s systems.

### Confidentiality of Communication

Users are responsible for protecting their privacy while using the WhatsApp number. It is advised not to share any sensitive information during the chat.

### Opt-Out Request

If you wish to stop using the service, you can simply cease communication with the merchant’s WhatsApp number. No further action is required to cancel the service, as there are no personal accounts associated with it.

### How to Place and Fulfill an Order via WhatsApp

Once you have selected the products you wish to order from the merchant’s menu, you can place your order by contacting the merchant via their dedicated WhatsApp number. Here are the steps to place and fulfill an order:

1. **Selecting Products**: Choose the products you want to order from the available merchant’s menu.

2. **Placing the Order**: Send a message to the merchant’s WhatsApp number containing the order details, such as the desired quantity, full delivery address, and any special instructions you wish to add.

3. **Verifying Details**: Ensure the accuracy of the information you send to the merchant, including the address and order quantity. You can review the message before sending it to ensure there are no errors.

4. **Order Confirmation**: Upon receiving your order, the merchant will process the order using MARKCOGNITION technology. The receipt of your order will be confirmed via a WhatsApp message indicating that your order has been successfully received and sent to the merchant.

5. **Payment**: The merchant will specify the appropriate payment method, which may include cash on delivery or other available electronic payment methods.

6. **Order Fulfillment**: After payment confirmation (if required), the merchant will prepare and ready the order for delivery. You will be updated on the order status via WhatsApp messages.

7. **Delivery**: The merchant will deliver the order to the specified address. In the event of any unexpected delay, you will be notified via WhatsApp message.

### Important Notes

– **Verifying Details**: It is essential to ensure the accuracy of all the details you enter and correct any errors before sending the message to the merchant. Once the message is sent, it may be difficult to correct any mistakes.

– **Payment**: If the payment method is not accepted or approved by you, you will be informed, and the merchant will not be obligated to fulfill the order.

By using our services via WhatsApp, you guarantee the accuracy and correctness of the information you provide to the merchant and commit to complying with the terms and conditions of the service.

### Order Cancellation

#### Food Orders

The customer is not entitled to cancel a food order and is not eligible for any refund if the order is canceled by the customer after the merchant has accepted the order, unless the cancellation is due to a fault or breach by MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C or the merchant. A food order is defined as any order from a restaurant, café, juice shop, or pastry shop.

If the merchant is unable to deliver the food order to the customer due to an action or inaction by the customer, or as a result of the customer’s negligence or failure, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C reserves the right to cancel the order without any refund.

#### Refunds

If the customer is entitled to a refund for a canceled order in accordance with the provisions of these terms and conditions, the amount paid by the customer for the order will be credited to the merchant’s account as a due balance, unless the customer requests otherwise. In this case, the refund will only be issued to the original payment source and method used to place the order. The refund period will range from 7 to 14 business days (and up to 30 days for international banks) for the amount to be returned to the customer’s bank account, according to the procedures followed by the merchant, credit card company, or bank.

### WhatsApp Delivery

#### Delivery Process

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C does not provide direct delivery services. The delivery process is carried out by the merchant after the order is processed via WhatsApp. Once all order details are submitted by the user, including the delivery location, the merchant organizes the delivery based on the provided details.

### Delivery Time

The merchant will deliver the order to the address provided by the user. The estimated delivery time is determined by the merchant based on various factors, such as the quantity ordered, distance, weather conditions, and traffic. Please note that the estimated delivery time is just an estimate, and orders may arrive either earlier or later than expected.

### Incomplete Deliveries

If the merchant is unable to deliver the order due to issues related to the user, such as:

– The absence of the recipient at the time of delivery.

– Inability to contact the user via the provided phone number.

– Difficulty accessing the delivery address.

In such cases, the merchant reserves the right to cancel the order without providing a refund for the amount paid.

### Incorrect, Missing, or Defective Orders

Upon receiving the order, if the user identifies any issues such as incorrect items, defects in the items, or missing items, the user must contact the merchant directly via WhatsApp to resolve the issue. The merchant may request photographic evidence or additional information to investigate the problem.

### Delayed Order Delivery

In the event of a significant delay in order delivery beyond the estimated time, the user should contact the merchant via WhatsApp to inquire about the cause of the delay. If the delay is found to be unjustified, the merchant is obligated to compensate the user according to their mutual agreement.

### Contactless Delivery

The user may choose the contactless delivery option (having the order delivered to the doorstep without face-to-face interaction). In this case, MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C is not responsible for any theft, damage, contamination, or deterioration of the goods after delivery.

### Important Notes

– Users should ensure the accuracy of the delivery details provided.

– The merchant is solely responsible for fulfilling and delivering orders.

### Order Pickup from the Merchant

#### Order Pickup Process

You may choose to pick up your order in person from the merchant’s location if this service is available. After confirming the order via WhatsApp, the merchant will specify an estimated pickup time (“pickup time”). The order should be ready for pickup at the specified time. Minor delays may occur, but the merchant will hold the order for up to thirty (30) minutes after the pickup time (“waiting time”). If you do not pick up the order within the waiting period, the merchant has the right to cancel the order and will no longer be obligated to provide it.

#### Responsibility for Pickup

If you unreasonably delay the pickup of your order, you are responsible for any damage, deterioration in quality, or change in the condition of the products (such as temperature changes that affect consumption suitability). In such cases, you will not be entitled to a refund or replacement of the products. You should inspect the order upon pickup and inform the merchant of any issues or defects via WhatsApp before leaving the merchant’s premises.

### Your Obligations as a User

**Data Protection**: The user must not attempt unauthorized access to any systems, data, or software belonging to other users, nor attempt to tamper with them.

**Personal Use**: The user is responsible for all activities carried out under their name. Personal data must not be shared or misused.

**Payment of Fees**: Customers are required to pay the applicable fees as notified when the products are delivered; otherwise, the products will not be delivered.

**Supervision of Minors**: Minors must obtain permission from their parent or guardian and use the service under their direct supervision.

**Use of Payment Cards**: The cards used for placing orders via WhatsApp must belong to the user or be used with the cardholder’s consent.

**Adherence to Privacy**: Users must respect privacy policies and refrain from distributing any legally prohibited information or sending unsolicited messages.

### Additional Notes

– **Responsibility for Pickup**: If the user unreasonably delays the pickup of an order, the user bears the responsibility for any damage, deterioration, or loss of quality of the goods.

– **Reporting Issues**: The user must report any issues or defects in the order directly to the merchant via WhatsApp immediately upon receiving the order.

### User Content and Conduct

### User Content and Prohibited Activities

Except for personal information (referred to as “personal data”) covered by the privacy policy of MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C, any material you send or post via WhatsApp is considered non-confidential and non-proprietary. MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C will have no obligations regarding such materials. #### Temporary Suspension and Permanent Discontinuation

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C may temporarily or permanently suspend or discontinue the operation of its system at any time without prior notice. The company is not liable to customers or any third party for any damages or losses resulting from this suspension or discontinuation.

#### Passwords and Access

We do not use an account registration or password system. All communications and transactions are carried out via WhatsApp, and the merchant is responsible for managing and confirming orders through their designated WhatsApp number.

#### Service Provision

MARKCOGNITION does not guarantee that its services will be performed on time, securely, or accurately, or that the results obtained from using the services will be correct and reliable, or that the service level will meet expectations. Our role is limited to facilitating communication between the merchant and the user.

#### Support and Deletion

MARKCOGNITION reserves the right to support or delete files and messages provided by users while using the services. The company is not liable for any support or deletion actions taken.

### Intellectual Property Rights

#### Ownership and Copyright

MARKCOGNITION retains ownership and copyright for all information, documents, software, designs, and graphics that it produces or acquires from third parties.

#### Unavailable Orders

MARKCOGNITION is not responsible for orders that are not delivered due to their unavailability with the merchant.

#### Content Publication

MARKCOGNITION may publish any information, documents, software, designs, or graphics created and uploaded by users to the system. These materials may be copied or published by other users, and in such cases, users are not entitled to any compensation from the company.

#### Error Correction

Merchants are responsible for correcting information related to the prices and specifications of the products offered for sale. In the event of incorrect information, MARKCOGNITION may correct the error by canceling the order.

### Service Modifications

MARKCOGNITION ARTIFICIAL INTELLIGENCE L.L.C reserves the right to convert non-membership services into membership-required services, offer additional services, modify some services partially or fully, or convert them into paid services.

### Maintenance and Updates

The system may be unavailable at times to allow for maintenance and updates. While we strive to notify customers in advance of service unavailability, this may not always be possible, and we reserve the right to modify or withdraw the service at any time.
